What do I do first after a critical incident?
Secure the scene per policy, decline to give a voluntary statement, and call counsel. Ask whether the interview is voluntary or compelled — that answer determines everything about how you should proceed.
What is a Garrity statement?
A statement your agency compels under threat of discipline. It generally can't be used against you criminally, but it can drive discipline and can taint a later criminal investigation if handled badly. We invoke and document the protections properly.
Can I be disciplined even if I'm not charged?
Yes. Administrative discipline uses a far lower standard than a criminal case, and a declination does not end your internal affairs or POST exposure. Those tracks need to be defended in parallel.
Is my legal defense plan accepted?
We work with FOP, association, and department legal-defense plans. Bring your plan details to the consultation and we'll confirm coverage and the intake process for your agency.
